Fazat e shumta të një realiteti të ri

Pavarësia e Kosovës përbën një realitet i cili ka kaluar nëpër shumë faza, nga tmerret e luftës në negociata të gjata, me ndërmjetësimin e Komunitetit Ndërkombëtar dhe Të Dërguarit Special të Sekretarit të Përgjithshëm

Ne jemi të kënaqur nga vendimi i Republikës së Serbisë për t’u tërhequr nga teksti i mëparshëm L.65, një tekst konfliktual dhe ndarës, me objektiva të ngushta të instrumentalizimit të Asamblesë së Përgjithshme dhe pengimit të procesit të konsolidimit ndërkombëtar të Republikës së Kosovës, tekst i cili në çdo rast do të hidhej poshtë nga ky organ i nderuar.

Ne mbështesim vendimin e mençur për ta zëvendësuar atë me një tekst të rënë dakord nga të 27 shtetet anëtare të BE-së, i cili ndodhet në tekstin e rishikuar L.65/Rev.1, një tekst ky tërësisht i ri dhe më realist dhe i sapo miratuar.

Zoti Kryetar,

Më 22 Korrik 2010, Gjykata Ndërkombëtare e Drejtësisë( GJND) dha Opinionin e saj Këshillimor mbi “Pajtueshmërinë e Shpalljes së Njëanshme të Pavarësisë së Kosovës me të Drejtën Ndërkombëtare”, në përgjigje të pyetjes së shtruar nga Asambleja e Përgjithshme e OKB-së me Rezolutën e saj 63/3 të datës 8 Tetor 2008: “A është shpallja e njëanshme e pavarësisë nga Institucionet e Përkohshme të Vetë- Qeverisjes së Kosovës në përputhje me të drejtën ndërkombëtare”?

Siç është tashmë e njohur për anëtarësinë e OKB-së, GJND-ja arriti më një shumicë dërmuese dhe me terma të qartë në përfundimin se Shpallja e Pavarësisë së Kosovës nuk shkel të drejtën ndërkombëtare, as Rezolutën e Këshillit të Sigurimit të OKB-së 1244 (1999), dhe as Kornizën e Përkohshme Kushtetuese të Kosovës, të miratuar nga UNMIK, në zbatim të asaj Rezolute. Opinioni i Gjykatës e bëri të qartë se rasti i Kosovës në fakt është unik, se ai ka sfondin e vet të gjatë historik dhe se ai nuk mund dhe nuk duhet të lidhet me asnjë situatë tjetër gjetkë në botë. Shqipëria e ka mirëpritur këtë vendim të Gjykatës Botërore dhe beson se ky Opinion duhet njohur dhe respektuar. Ne jemi të kënaqur që në këtë drejtim, teksti i ri e mirëpret Opinionin e GJND-së.

Zoti Kryetar,

Pavarësia e Kosovës përbën një realitet i cili ka kaluar nëpër shumë faza, nga tmerret e luftës në negociata të gjata, me ndërmjetësimin e Komunitetit Ndërkombëtar dhe Të Dërguarit Special të Sekretarit të Përgjithshëm. Ky realitet po njihet gjithnjë e më shumë nga shtetet anëtare. Sigurisht që opinioni i GJND-së do të ndihmojë shumë vende për të kaluar drejt njohjes së Republikës së Kosovës, meqenëse ajo ofron edhe perspektivën e një faze të re në marrëdhëniet midis Republikës së Serbisë dhe Republikës së Kosovës, duke përfshirë edhe perspektivën e integrimit të tyre në BE, synim ky i përbashkët për gjithë rajonin.

Shqipëria është e vëmendshme ndaj vështirësisë së disave në Qeverinë e Serbisë për t’u pajtuar me këtë realitet të ri dhe ajo çka ndodhi sot në Asamblenë e Përgjithshme e ilustron qartë atë. Por, pavarësisht nga kjo, ne konstatojmë me kënaqësi se teksti i tanishëm L.65/Rev.1 duket qartë se nuk ka asgjë të përbashkët me tekstin e vjetër dhe kjo është arsyeja përse Republika e Shqipërisë vendosi ta mbështesë atë.

Shqipëria shpreh vlerësimin e saj të thellë për përpjekjet e BE-së së bashku me ato të vendeve të tjera qe e kanë njohur Kosovën për ta sjellë Serbinë në një pozicion të arsyeshëm, nëpërmjet paraqitjes së kësaj Rezolute.

Zoti Kryetar, është me të vërtetë tejet pozitive që në vend të thirrjeve të kota për rifillim të bisedimeve mbi statusin e Kosovës, një proces ky tërësisht i shteruar dhe një kapitull i mbyllur përfundimisht, teksti i ri mbështet përpjekjet në vazhdim dhe inkurajon Serbinë dhe Kosovën për t’u angazhuar në një proces bashkëpunimi mbi çështje praktike në interes të të dy vendeve, në frymën e fqinjësisë së mirë. Shqipëria do të japë mbështetjen e saj të plotë në këtë proces.

Mr. President,

We are pleased with the decision of the Republic of Serbia to withdraw the previous text L.65, a controversial and disruptive text, with narrow objectives of instrumentalizing the general assembly and hinder the progress of international consolidation of the Republic of Kosovo, a resolution which would have been rejected in any case by this august body.

We support the wise decision to substitute it with a text agreed with the 27 EU member states and that is contained in L.65/Rev.1., a complete new and more realistic text, just adopted.

Mr. President,

On 22 July 2010, the International Court of Justice (ICJ) delivered an advisory opinion in “Accordance with international law of the unilateral declaration of independence in respect of Kosovo”, in response to the question put forward by the General Assembly in the resolution 63/3, of 8 October, 2008: “Is the unilateral declaration of independence by the Provisional Institutions of Self-Government of Kosovo in accordance with international law?”.

As it is known to the membership, the ICJ concluded by an overwhelming majority and in unambiguous terms that Kosovo’s Declaration of Independence violated neither general international law nor Security Council resolution 1244 (1999), nor the Provisional Constitutional Framework of Kosovo, adopted by UNMIK, pursuant to that resolution. The Court’s opinion made it clear that Kosovo’s case is in fact unique, it has its own long historical background and that it cannot and should not be related to any other situation elsewhere in the world. Albania welcomes this rendering of the World Court and believes that this Opinion should be acknowledged and respected. We are pleased that the new text welcomes the ICJ opinion with respect.

Mr. President,

Kosovo's independence is a reality that has undergone many difficult phases, from war atrocities to lengthy negotiations under the mediation of International Community and Secretary General special envoy. This reality is increasingly recognized by the member states. The ICJ opinion will certainly help many countries to move towards recognition of the Republic of Kosovo as it offers as well the prospect of a new phase in the relations between the Republic of Serbia and the Republic of Kosovo including within the perspective of their integration into European Union, a goal shared by the whole region.

Albania is attentive to the difficulty of some in the government of Serbia to come into terms with this new reality and what happened today at the GA hall is a clear illustration. But, despite this, , we notice with satisfaction that the current text of L.65/Rev.1 has clearly nothing in common with the old text and this is the reason why the Republic of Albania decided to support it.

Albania expresses its deep appreciation for the efforts of the European Union along with that of other countries that have recognized Kosovo, to bring Serbia to a reasonable position by presenting this new resolution.

Indeed, Mr. President, it is very positive that rather than calling in vain for renewed talks on the status of Kosovo, a process already fully exhausted and a chapter definitively closed, the new text supports efforts underway and encourages Serbia and Kosovo to engage into a cooperation process on practical matters in the interest of both countries in the spirit of good neighborhood. Albania will lend its full support to such a process.
